Welcome to Agent Tunnel. By using our software and services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using Agent Tunnel ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software. Your use of the Software constitutes your acknowledgment that you have read, understood, and accepted these Terms in their entirety, including all disclaimers, limitations of liability, and assumptions of risk.

2. Description of Service

Agent Tunnel is a desktop application that provides remote access to Claude Code, an AI coding assistant developed by Anthropic, PBC. The Software enables you to send instructions to Claude Code from a mobile device via a secure tunnel. Claude Code operates on your local machine under your user account and system permissions.

The Software is a remote control interface. It does not itself provide AI capabilities. All AI functionality is provided by Anthropic's Claude Code, which is a separate product governed by Anthropic's own terms of service and acceptable use policies. You must independently agree to and comply with Anthropic's terms before using the Software.

3. Autonomous Execution — Nature of the Software

3.1 How It Works

The Software invokes Claude Code with permission controls disabled. This means the AI assistant can, without prompting you for confirmation:

• Read, create, modify, overwrite, and delete files and directories
• Execute shell commands and scripts
• Install, update, or remove software packages
• Access network resources available to your user account
• Interact with any service, API, or system accessible from your machine
• Make changes to system configuration files accessible to your user account

While the Software provides a configurable workspace directory, this is a starting directory for convenience, not a security boundary. The AI operates with the full permissions of your user account and is not sandboxed or restricted to any particular directory.

3.2 Inherent Risks

AI systems, including Claude Code, may produce incorrect, unexpected, or unintended outputs. The autonomous execution model means these outputs are applied to your system immediately and without prior review. Risks include but are not limited to:

• Data loss: Files may be overwritten, corrupted, or deleted
• Unintended modifications: Code, configuration, or system files may be altered in unexpected ways
• Security exposure: The AI may inadvertently create security vulnerabilities, expose credentials, or install compromised packages
• Resource consumption: Commands may consume excessive CPU, memory, disk space, or network bandwidth
• Service disruption: Actions taken by the AI may affect running services, databases, or deployments
• Financial impact: The AI may interact with paid APIs, cloud services, or other billable resources, potentially incurring charges on your accounts

3.3 Your Responsibilities

By using the Software, you agree that you are solely responsible for:

• Maintaining current, complete backups of all data on any machine where the Software operates
• Reviewing all changes made by the AI before deploying them to production environments
• Configuring appropriate access controls and permissions on your system
• Monitoring AI sessions and intervening when necessary
• Understanding the capabilities and limitations of AI-generated code and commands
• Ensuring your use complies with Anthropic's terms of service and acceptable use policies
• Any and all consequences of commands executed by the AI on your behalf

4. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK. YOU UNDERSTAND THAT THE SOFTWARE ENABLES AN AI SYSTEM TO EXECUTE COMMANDS ON YOUR COMPUTER WITHOUT PER-ACTION APPROVAL, AND THAT THIS CREATES INHERENT AND SIGNIFICANT RISKS INCLUDING DATA LOSS, SYSTEM DAMAGE, SECURITY VULNERABILITIES, AND FINANCIAL HARM. YOU VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER KNOWN OR UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OR FAULT OF THE PARTIES RELEASED BELOW.

YOU WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL CLAIMS AGAINST AGENT TUNNEL, BEAMER LABS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FOR ANY DAMAGE, LOSS, OR INJURY ARISING FROM OR RELATED TO THE AUTONOMOUS EXECUTION OF COMMANDS BY THE AI, REGARDLESS OF THE CAUSE.

5. License Grant

Subject to your compliance with these Terms and valid license activation, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal or business purposes.

6. License Types

We offer three license types:

• Monthly Subscription: Provides access to the Software for 30 days from purchase. Automatically renews unless cancelled.
• Annual Subscription: Provides access to the Software for 365 days from purchase. Automatically renews unless cancelled.
• Lifetime License: Provides perpetual access to the current major version of the Software (version 1.x). Future major versions may require a separate purchase or upgrade fee.

7. Machine Activation

Each license is activated on a single machine. If you need to transfer your license to a different machine (e.g., when upgrading computers), please contact support. We allow reasonable transfers but reserve the right to limit excessive transfer requests.

8. Acceptable Use

You agree NOT to:

• Share, resell, or redistribute your license key
• Attempt to reverse engineer, decompile, or disassemble the Software
• Use the Software for any illegal purpose or to generate harmful, malicious, or illegal content
• Circumvent or disable any license validation mechanisms
• Use the Software in a way that could harm, disable, or impair our services
• Use the Software to intentionally damage, attack, or compromise any system, network, or service
• Use the Software in production environments, on servers containing sensitive data, or on systems you do not own without implementing appropriate safeguards, backups, and access controls

9. Third-Party Services and Dependencies

The Software integrates with or depends on third-party services including:

• Anthropic (Claude Code): Provides the AI coding assistant. You must have a valid Anthropic account and agree to their terms. We are not affiliated with Anthropic and have no control over Claude Code's behavior, outputs, or availability.
• Cloudflare: Provides secure tunneling between your device and your machine
• LemonSqueezy: Processes payments and manages subscriptions

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or functionality of third-party services. Changes to third-party services, including but not limited to API changes, pricing changes, or service discontinuation, may affect the functionality of the Software without notice.

10. No Warranty on AI Output

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR QUALITY OF ANY OUTPUT GENERATED BY AI SYSTEMS ACCESSED THROUGH THE SOFTWARE. AI-GENERATED CODE, COMMANDS, AND SUGGESTIONS MAY CONTAIN ERRORS, SECURITY VULNERABILITIES, OR LOGIC FLAWS. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, TESTING, AND VALIDATING ALL AI OUTPUT BEFORE RELYING ON IT.

11. Data and Privacy

Please refer to our Privacy Policy for information about how we collect, use, and protect your data.

12. Refund Policy

We offer refunds under the following conditions:

• Monthly/Annual Subscriptions: Full refund within 7 days of initial purchase if you have not activated the license. Prorated refunds may be considered on a case-by-case basis for activated licenses.
• Lifetime Licenses: Full refund within 14 days of purchase if you have not activated the license. Once activated, refunds are at our discretion.

13. Subscription Cancellation

You may cancel your subscription at any time through your LemonSqueezy customer portal. Upon cancellation:

• Your license remains active until the end of your current billing period
• No further charges will be made
• After expiration, the Software will require a new license to function

14. Updates and Support

We may release updates to the Software at our discretion. While we aim to provide support, we do not guarantee response times or resolution of all issues. Support is provided via email at support@agenttunnel.app. We reserve the right to discontinue support or updates at any time.

15. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES THAT THE AI WILL PRODUCE ACCURATE, CORRECT, SAFE, OR RELIABLE OUTPUT
• WARRANTIES THAT THE SOFTWARE WILL NOT CAUSE DATA LOSS, SYSTEM DAMAGE, OR OTHER HARM
• WARRANTIES REGARDING THE AVAILABILITY OR CONTINUITY OF ANY THIRD-PARTY SERVICE

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS, ARISING FROM OR RELATED TO YOUR USE OF THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
• WITHOUT LIMITING THE FOREGOING, THE RELEASED PARTIES SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGE, LOSS, COST, OR EXPENSE ARISING FROM OR RELATED TO: (A) COMMANDS EXECUTED BY THE AI ON YOUR SYSTEM; (B) DATA LOSS, CORRUPTION, OR MODIFICATION CAUSED BY AI-GENERATED ACTIONS; (C) SECURITY VULNERABILITIES INTRODUCED BY AI-GENERATED CODE; (D) FINANCIAL CHARGES INCURRED THROUGH AI INTERACTIONS WITH PAID SERVICES; (E) SYSTEM INSTABILITY, DOWNTIME, OR DAMAGE RESULTING FROM AI-EXECUTED OPERATIONS; OR (F) ANY OTHER CONSEQUENCE OF THE AUTONOMOUS EXECUTION MODEL DESCRIBED IN SECTION 3.
• OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

17. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees and legal costs) arising from or related to:

• Your use of the Software
• Actions taken by the AI on your system or on your behalf
• Your violation of these Terms
• Your violation of any applicable law, regulation, or third-party right
• Any claim by a third party arising from the operation of the Software on your system, including but not limited to claims related to data loss, privacy breaches, intellectual property infringement by AI-generated content, or service disruptions
• Your failure to maintain adequate backups, access controls, or security measures

18. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of the Software after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Software.

19. Termination

We may terminate or suspend your license immediately and without prior notice if you violate these Terms. You may terminate your use at any time by uninstalling the Software and deactivating your license. Upon termination for any reason:

• Your right to use the Software ends immediately
• You must uninstall and destroy all copies of the Software
• No refund will be provided for termination due to violations
• Sections 3, 4, 10, 15, 16, 17, and 20 survive termination

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Software shall be resolved exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of such courts. You agree to waive any right to a jury trial in connection with any action or litigation arising from these Terms.

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATED TO THE SOFTWARE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE, OR BE FOREVER BARRED.

21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Agent Tunnel regarding the use of the Software and supersede all prior agreements, understandings, and communications, whether written or oral.
